- We are looking to recruit a Contract & Commercial Manager to be based in Riyadh
Purpose of the job:
- The Project Commercial Manager is responsible to lead the Project CoreTeam in Contractual Obligation Management, Contract Administration and Claim Management.
- The role supports the Project Director in complying with all contractual requirements and the identification, communication and negotiation with the customer and with partners of all contract related issues, e.g. variations and claims.
Responsibilities:
Functional duties to the Project Core Team:
- Ensure that all Project Team Members have read, understood and act according to the agreed contracts
- Monitor obligations of and towards all contractual partners (e.g. Customer, Suppliers, Partners) are met in time
- Continuously seeking for challenges and opportunities to identify and propose actions for improvement of the project’s contractual situation
- Contribute to the grow of project scope, revenue and margins, or the avoidance of slippage of the same through effective administration of the contract and the implementation of a variation order and claim management processes
- Participate in project review meetings, risk mitigation meetings where appropriate and any forum which may detect or review early warning indications of problems and /or delays
- Review all arguments, calculations, opinions, etc. and challenge the respective functions before any internal decision is taken on any potential offensive claim or received defensive claim and before any statement is submitted to the opponent
- Monitor, validate and question the work done in each section of the claim (technical, financial, contractual/legal and scheduling) in relation to provisions and the agreed contract
- Ensure that all relevant functions are involved at the adequate time and according to the BTIP and Bombardier processes and policies
- Establish and implement, jointly with the Project Director and the Project Control Manager, the project commercial strategy towards the Customer and Partners
- Establish, communicate and manage the Contractual Obligation Management Processes and ensure- together with Project Control Manager - that Project Change Management is fully integrated
- Ensure, together with the Financial Controller, that the required bonds and insurances are put in place as well as the timely preparation and agreement of invoices and/or payment requests
- Report all claims to the Contract function according to the BT reporting rules
- Liaise with Contracts/Legal on all matters requiring their involvement including the reporting of all claims according to BT reporting rules
- Leadership duties within the Project Core Team;
- Lead the application of the Contractual Obligation Management Process, including the Contract Administration and Claims Management Processes and including the respective tools
- Lead in the documentation of the Master Contract with the Customer as well as all teaming agreements and Purchase Contracts with the Suppliers during project execution, including all amendments, routine variation orders and change orders.
- Lead in the safe-keeping and archiving of all contract- and claim-related documentation, the keeping of a claim-log; and the single source of the complete and updated contracts at all stages of project execution
- Ensure that the Project Core Team Members are trained in Contractual Obligation Management
Specific responsibilities to other Project Core Team roles;
- With Supply Management, liaison on the placement of all major Purchase Contract agreements to ensure Master Contract adherence and the ongoing commercial management of the Purchase Contracts once placed
- With Risk Management, ensuring all risks and opportunities are quantified and taking ownership of all contractual risks and opportunities.
Qualifications
Requirements:
- 10 years of experience in a relevant role.
- Contractual obligation management, contract administration and claim management experience.
- Legal background preferable.
- Previous experience in a large project is required.
- International working experience.
- Proven leadership performance.
- Strong communication abilities.
- Ability to travel.
